Hi, thank you for tuning into my YouTube channel. Today, we're going to be talking about the STEM OPT problem that we get a lot of questions on. So basically, USCIS changed their STEM OPT website in April of this year. However, the date on the website actually says January. We were only notified about this new STEM OPT policy change in April. This policy change states that STEM OPT students cannot work off-site and must work at the location of their employer who signs the I-93. This creates a huge problem for many IT STEM OPT applicants because they work at client sites. As a result, we've been receiving a lot of inquiries on this issue. I wanted to summarize it to see if there are any solutions. Currently, USCIS is telling everyone, at least on their website, that they need to work at the location of the employer site. Any third-party client location placements will not be acceptable. The reasoning behind this is that ICE cannot have access or authority to visit the work sites where inspections will take place. Due to this lack of inspection capability, ICE cannot establish the bona fide employer-employee relationship required for approving STEM OPT applications. This creates confusion, especially for those STEM OPT applicants who have already been approved to work at client sites. Firstly, I want to mention that this type of enforcement and interpretation of the rule is not supported by law. Although the STEM OPT regulations do require a bona fide employer-employee relationship, ICE stated in a preamble document that they do not consider third-party client placements to be satisfactory. They cannot verify that the training provided is directly from the employer.
