Hello and welcome back to immigration news and views. My name is David Nachman, one of the managing attorneys at the Endowment for One Easy Mode Check Law Office. We have offices in Ridgewood, New Jersey and a office in midtown Manhattan. We also have an affiliated office in India and another in Canada. One common question we receive from clients involved in marriage cases is how to demonstrate the bona fide nature of the marital relationship. Essentially, a bona fide relationship refers to a relationship entered into in good faith. The government will be looking for certain types of documents but it is not just the documents that matter in a marriage case. We advise clients that it is not only what they say or show, but also how they present the evidence. Nonverbal cues are important, such as how the spouses interact during the interview. For example, if a husband and wife sit on opposite sides of the table and seem distant, it may raise suspicion about the legitimacy of the marriage. Officers at USCIS are trained to observe these nonverbal cues. Apart from nonverbal cues, the documents presented also play a crucial role. The most important document is the marriage certificate. While certificates from localities are generally good, those from Las Vegas or from outside the country may raise doubts. Consulting with competent legal counsel is recommended to address any potential issues related to where the marriage took place and the validity of the marriage certificate. Other documents that can help demonstrate the bona fide nature of the marital relationship include utility bills that are addressed to both the husband and wife.
